A successful vacation today is very important and there belong clear legal rules as well.  The conditions represented here become components of the contract when booking with us. Therefore, before you book your hotel or your vacations, you should take time for these lines.

GENERAL TERMS AND CONDITIONS FOR ACCOMMODATION SERVICES AND BOOKING TERMS
( private accommodation, hotels, villas, )

1. GENERAL
Travel agency Kristofor D.o.o., in further text only Kristofor, offers accommodation rental services after the published informations, according to the description and the term of stay, as confirmed in the final reservation.
Kristofor acts as a letting agent ie. mediate agent for the accommodation provider eg. property rentier of featured accommodations, in further text also reffered to as hosts and/ or hotels. The renting contract incorporates all the conditions below and by sending the reservation request you agree to be bound by this Booking terms and Conditions for accommodation rental services. Thus, everything stated in the Booking Conditions becomes legally binding. On hotel bookings also apply the rules of the house in question and the usual norms of hotel industry. Croatian Law governs your accommodation rental and all matters arising out of it.

2. MAKING A BOOKING AND PAYMENT
2.1 Once you have made a provisional reservation enquiery with us you are considered prospective custumer. The total booking record for the party is entered under the name of the the first named person on the booking form ('the party leader'). The party leader must be at least 18 years of age and must be authorised to make the booking on the basis of these booking conditions by all persons named on the booking. By filling and sending the booking enquiery form the party leader confirms that he/she is so authorised and that all party members agree to be bound by the booking conditions. During reservation request you are obliged to give all necessary details required for booking procedure. You will receive personal offer with the details in written ( fax/ email).

2.2 The party leader is responsible for making all payments due to us ( deposit and the balance). The completed form is considered an enquiery entry only. Reservation is valid only on arrival of a fully paid deposit as specified in the offer and with the sent final reservation confirmation on our part. Deposit is to be paid by bank-transfer, all transaction costs fall on behalf of the sender. Debit procedures abroad are not possible, we do not accept foreign country checks or credit cards neither because the settling costs and procedures for this takes a large part of the calculation sum.
The total balance of your booking must be settled by 3rd day after arrival.  Calculation is in HRK equivalent to the middle exchange rate of HNB on the day of payment.

You may make a booking request over the fax or email or via our website www.kristofor.hr . Bookings received in this way are provisional and will be held pending until the receipt of your deposit as applicable. If your payment is not received within thespecified time-limit stated in the offer, the booking will automatically lapse. The reservation comes into existence after you have paid a deposit, then we accept your booking by issuing a written confirmation. With advance payment with the advance and booking you accept our General terms and conditions as formaly binding.

For Group reservations in Hotels in general; reservations are valid only with advance of 30% by booking and the full payment at least 40 day before arrival and with our written confirmation. Herealso you are obliged to fax the copy of the payment, until the paiment is received, the booking is considered provisional and in case we do not receive the payment copy to the time due, the offer will automatically lapse. Usual practises and rules in branch / hospitality industry in Croatia apply. Rooming lists and other conditions will be stated in the offer.

2.3 Bookings cannot be accepted from parties less than 18 years of age. We reserve the right to refuse a booking without any given reason.

2.4 Kristofor as a letting agent takes care about implementing the negotiated services, about choosing the hosts, as well as about guest interests, as practised in general custom norms and regulations in tourist industry and governed by croatian laws. Kristofor shall honor the negotiated services in the good faith of the trade in full as described, except in extraordinary circumstances ( article22.2)

3. COURT JURISDICTION
Any disputes,which arises out of or in connection with this contract, will be dealt with by all parties involved in such a manner as to reach mutual agreement. If this is not possible, juristiction lies with the local court in Rab. Legaly binding version of these conditions is croatian.

4. PRICES
4.1 The price of accommodation includes the basic service as described in the booked accommodation unit.
Special services are those not included in the price of accommodation (in accommodation unit description indicated by "services upon agreement" or "additional services" available if arranged in advance); therefore the customer pays for them separately. These services must be requested at the time of booking.

4.2 The price of your accommodation is based on property prices known to us at the time of offering for the current season. These costs may vary between the time when offered and when you check into your property. As a result, the price of your accommodation is subject to surcharge on the following items: government action, currency. Even so we will absorb an amount equivalent to 1,5 % of the accommodation price difference. Only amounts in excess of this 1,5 % will be surcharged. If this means paying more than 10% of the accommodation price, you will be entitled to cancel your holiday with a full refund of the money paid to us.

4.3 Many property owners will only accept bookings with a minimum of two weeks in July and August.

4.4 Properties are let fully furnished and equipped in accordance with the category standard. The price for all properties includes linen, electricity, hot and cold water. Where there is a private pool, pool heating will incur an additional expense as might also air conditioning/heating where available. Swimming pools are not open all year. Please check with us as to whether the pool is open or not. Satellite/Cable television where available may not include access to all channels.

5.0 CHANGES BY YOU
If you are prevented from travelling, you have a right to transfer your booking to another person and/ or another date. However, you must tell us you want to do in writing more than 42 days before arrival. We will charge an amendment fee of EUR 30 per booking. You will also be liable for any additional costs caused by this transfer. Until we receive the confirmation from the person taking your place, you are responsible for full payment of the accommodations ordered. Please refer to paragraph headed 'Other Changes' with regard to accommodations transfer within 42 days of arrival.

6.0 OTHER CHANGES
If you wish to make other changes to your booking after it has been confirmed you must notify us in writing as soon as possible. We will endeavour to assist you but cannot give any guarantees. An administrative fee of EUR 30 per booking will be applicable along with any additional costs incurred as a result of the change. If you wish to amend your booking within 42 days prior to arrival, we may treat this as a cancellation. In this instance the charges as stated in the cancellation charge table in paragraph 7.1 will apply.

7.0 CANCELLATION
7.1 If you wish to cancel your booking you may do so either by sending us a letter recorded delivery. E-mail cancellations will be accepted from overseas clients. In all cases cancellation will only be accepted from the party leader. If you do cancel you will have to pay cancellation charges. The amount you pay depends on the date we have been informed of the cancellation in writing. This also applies to hotel bookings. The following cancellation charges apply:

7.2 Cancellation charges are calculated as a percentage of the total cost. Cancellation charges exclude administrative fees  which are non-refundable in the event of your cancellation. In case of cancellation due to force majeure, the customer must produce a written statement issued by the authorized institution, and Kristofor will charge only the actual costs, up to a maximum of 25% of the total. Depending on the reason for your cancellation, you may be able to re-claim these cancellation charges (less any applicable excess) under the terms of your insurance policy. Claims must be made directly to the insurance company concerned. We recommend that you purchase travel insurance before travelling.

7.3. Should you not arrive at the booked accommodation unit before midnight on the arrival date, and you have not conntacted us, the reservation is considered to be cancelled, and therefore the cancellation costs will be charged as described above. Should the real costs exceed the above stated costs, Kristofor reserves the right to charge the difference.

8. CHANGES AND CANCELLATIONS BY US
8.1 We reserve the right to modify the offer in case of change of important circumstances during the booking process. In the unlikely event that alterations and cancellations have to be instigated by us after the booking is made, we will inform you as soon as possible and try to arrange alternative accommodation of a similar type, standard and location.
Should the substitute accommodation be available only in an accommodation unit of higher category and should the price of the substitute accommodation be higher by 10% or more than the initially booked accommodation, Kristofor reserves the right to charge the price difference upon consulting the customer.
In cases where substitute accommodation for paid accommodation is not available or you do not agree with the offered alternative, Kristofor reserves the right to cancel thereservation upon prior customer notification.

8.2 If no alternative accommodation is available or accepted, we will refund in full all money paid to us and shall be under no other liability.

9 COMPLAINTS
9.1 Procedure with complaints:
If you have a problem whilst at your booked accommodation, please bring it to our attention, so that we have an opportunity to put it right at the time. Failure to alert us of any problem whilst you are in the accommodation will lead to a rejection of any later complaint. You are obliged to cooperate with Kristofor and the host in good will to renounce the source of complaint.

Clients that decide to leave the beforehand reserved accommodation in a house with the name are obliged to pay for the booked period in full. We make no return payment based on your earlier departure or change of mind for selecting the property because of its location, quality of fittings or furnishings, noise, privacy, size, extent of view or ambience, unsuitability or any other aspect based on subjective assessment or opinion. Cleanliness - if you are not satisfied with the cleanliness of a property upon your Arrival, you must contact the Property Owner immediately or notify us to arrange a repeated cleaning.
For 'no name' apartments and voucher quests of other agencies Kristofor obliges to offer alternative accommodation that fits the type of the reserved one, but only complaints that are dealt with during the stay and those whose cause of problem could not be repaired will be considered valid and the maximum amount of refund can reach only the amount of paid deposit and cannot span to already consumed services nor to the total costs. If alternative solution that fits the paid service is refused at the spot, later claims will not be accepted nor answered. Ammendment to the ideal reparationis not possible and later complaints are not accepted.

10 ARRIVAL AND DEPARTURE
10.1 There is no fix hour of arrival. As soon as the accommodation is ready, you can enter it. As a rule Guests are expected to arrive between 12.00 and 19.00 h Croatian time and to depart by 10.00 am. If your arrival is outside these times, you are obliged to conntact us beforehands. If you arrive after 22.00h you may not be able to access the property until thefollowing day.

10.2 Details of whom to meet at the accommodation are given to you once you check in at the reception.

11 YOUR RESPONSIBILITIES
11.1 As a foreign visitor you must have valid travelling documents, obey custums and other regulations of Republic of Croatia and when at the rented property, comply with the House rules and act in good will with the hosts. On your arrival you are obliged to check in at the Kristofor reception and present a reservation document ( original voucher or reservation confirmation letter) and valid documents ( usually passport) from all quests. It is your obligation to check wether you need visa to enter Croatia or neighbouring countries.
In case of irresponsible behaviour regarding travelling requirements, the guest is liable for charges,
same as in case of cancellation ( article 7.1).

11.2 You must keep the property and all furniture, fittings, effects, facilities, equipment and grounds in the same state of repair and condition as at the commencement of your holiday. Final cleaning is included in the price, however you are expected to keep the reasonable state of cleanliness and in the same general order in which it was found. You will be responsible for any breakages, loss or damage to the property. The property rentier reserves the right to charge you for any extra cleaning and to claim compensation for damages. Kristofor does not have any responsibilities regarding the loss or damage through the rental to the property owner nor to the rent custumer, neither is the mediator between the two.
Any eventual damages to the rented property is subject to compensation directly between the property owner and the rent taker.

11.2 The parking of caravans/pitching of tents is strictly forbidden.

12 NUMBER OF PEOPLE USING THE PROPERTY
Only those persons named on the booking form may use the property without prior agreement. The maximum number of people, including infants, allowed at the property may not be exceeded. The host has the right to terminate the rental without prior notice and without refund if the numbers are exceeded, or charge extra for additional person if there would be enough space in the rented accommodation unit.

13 ACCESS
The property rentier or their representative shall be allowed reasonable access to the property to carry out urgent
maintenance and/or inspection.

14 HOUSE ORDER
Every house has an house order, mainly they are similar to this house order draft.
Should you or a member of the party behave savagely and disregard the house order, the property rentier may use their absolute discretion and ask you and the party to vacate the property without refund. This does not exculpate you from the responsibility for any breakages, loss or damage to the property. In these circumstances, no refunds are made.

15 ADDITIONAL SERVICES
Please give as much time as possible to organise additional services if required. Payment for such services is usually made locally. We cannot accept responsibility for any extra services by other providers.

16 LINEN
Linen and linen change is included in all properties. It is advisable to take a beach towel and to check that cot linen is provided.

17 SOCIAL EVENTS AND OTHER FUNCTIONS
If you are intending to organise a private function (e.g. party, wedding, cocktail party) at the property, you must seek prior
permission. Additional charges and/or increased deposit may be sought at the rentier's discretion.

18 SECURITY AND VALUABLES
Kristofor is not liable neither for any loss, ruined or damaged baggage or it's theft.
Any valuables left at the property are left at your own risk. Neither Kristofor nor the property rentier is responsible for their loss. No refund can be given should you decide to vacate the property as a consequence of a burglary.
Lost belongings or theft should be reported to the host and to the local police station.

19 INFORMATION
19.1 While we make every effort to ensure that descriptions supplied are accurate, information presented may contain accidental, grammar or typing mistakes. You must accept that minor differences between the photograph/illustration/text used and actual property may arise. Tolerance of +/- 20% applies to all numerical values (areas, distances,). Stated distances are based on air distances unless stated otherwise. Also, please note that accommodation, food, services or other standards vary in different places and countries, therefore cannot be comparable. Offered accommodation units are described after the official categorisation of the issuing institution ( e.g. croatian Office for Tourism) and through our insight in the real condition of the capacities. Changes, additions and information corrections are made continually. Kristofor is not liable for direct, indirect, criminal or any other damages that are the result of using information presented.

19.2 Property rentier reserves the right to make modifications to the property specifications that are considered necessary in light of operating requirements. In the interest of continual improvement, property rentiers reserve the right to alter furniture, fittings, amenities, facilities or any part of any activities, either advertised or previously available without prior notice.

19.3 If major material changes occur after your booking has been confirmed, we will advise you if there is time before departure.

20 PETS
Pets are not allowed unless with the explicit permission of the host. The rentier reserves the right to add a surcharge and/or increase the deposit. Number of pets must be agreed prior to acceptance of booking.

21 OUR LIABILITY AND THE PROPERTY OWNER
21.1 Neither Kristofor travel agency nor the property rentier shall be responsible for the death of, or
personal injury or illness of any member of a booking party, or of any other person at the property if not otherwise explicitely proven.

21.2 Circumstances beyond our control: act of God clause: disasters/ force majeure

We shall not be liable for any loss, breach or delay due to any cause beyond our reasonable control including though not limited to acts of God, explosion, tempest, fire or accident, natural disasters, war or threat of war, civil disturbances, acts, restrictions, regulations, laws or measures of any kind on the part of the government or local authority, strikes, lock-outs or other industrial actions or disputes. Also, natural calamities and further other circumstances such as extraordinary weather conditions, death of the owner, divorce of the owner, unannounced sale and/or occupation of the holiday rental by the owner in which complete or partial compliance with the agreement cannot be demanded to reasonableness and fairness from us, we shall be entitled to treat the rent contract as discharged.

21.3 On the event of discharge our liability shall be limited to the return of the sums paid to us in respect of the unused portion of the rental calculated on a pro rate daily basis less an administrative fee of EUR 30 to cover our reasonable expenses in case of full payment beforehand.
In case of apartment deposits, these are not refunded in case of events beyond control taking place 15 days prior to arrival or less.

21.4 We cannot be held responsible for the breakdown of mechanical equipment such as pumps, boilers, swimming pool filtrations systems, nor for the failure of public utilities such as water, gas and electricity.

21.5 Neither Kristofor nor the host can be held responsible for noise or disturbance originating beyond the
boundaries of the property or which is beyond our control.

21.6 We cannot accept responsibility for events out of our control e.g. bad weather, delays caused by carrier companies, breakdown of domestic equipment, hotel overbookings.

22 LOW SLUNG CARS People taking low/sports cars are advised to check that the access to the property is suitable.

23 TOURIST TAX
The existing Law regulations prescribe that every guest must pay daily tourist tax fee together with the accommodation bill. Tourist tax fee is inclucded in the accommodation price.

24 NOTE
Upon payment of the advance the customer accepts the Booking Terms and Conditions in their entirety.
